These Terms & Conditions (also referred to as the "Terms", "Agreement", or "EULA") are a legal agreement between you ("you" or "User") and Binary Work, LLC ("we", "us", "our" or "Company"), governing your access to and use of the Rubber macOS application (the "App") and related services, websites, and content (collectively, the "Service"). By downloading, installing, accessing, or using the App or Service you agree to be bound by these Terms. If you do not agree, do not use the App.
Subject to your compliance with these Terms and payment of any applicable fees, Binary Work, LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App on devices you own or control, strictly in accordance with the functionality provided. The license is granted on a per-user basis and not as an unlimited or enterprise license, unless you obtain a separate written agreement from us.
Rubber is available as a free edition with limited features. Feature availability, limits, and behavior for the free edition are determined by us and may change over time.
We offer an optional one-time purchase that unlocks lifetime access to premium features as described at the point of sale. Lifetime licenses are granted to the purchasing user and are non-transferable except as explicitly permitted by us in writing.
If you subscribe to a paid plan, your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. Subscriptions purchased through the App Store are billed by Apple and are subject to Apple's terms, including auto-renewal and cancellation procedures. You can manage or cancel your subscription through your Apple ID account settings. Refunds for purchases made through the App Store are handled by Apple in accordance with Apple’s policies.
All prices, taxes and payment terms are as presented at the time of purchase. For App Store purchases and subscriptions, Apple processes payments and handles receipts. Any refund requests for purchases made through the App Store must be submitted to Apple; we may assist but cannot directly issue refunds for App Store transactions. For purchases made directly from us (if offered), refund terms will be displayed at the point of sale.
Rubber is a GUI tool for connecting to and managing Elasticsearch and OpenSearch clusters. It is intended to assist with debugging, development, and administrative tasks such as running requests (including exporting as cURL), viewing and editing documents, bulk operations, templates, and index management. The App supports features including (but not limited to): multiple connections, multiple tabs per connection, pin indices/aliases, export requests as cURL, large JSON handling, bulk requests, templates, table view, read-only connections, Mutual TLS, syntax highlighting, multiple copy formats, dark theme, and compatibility with Elasticsearch 6+ and OpenSearch.
The App requires either an internet connection or local network connectivity to reach your targets. You may connect to remote clusters over the internet or to local clusters on your LAN. All connectivity and data access are initiated by you; we do not connect to your clusters on our own.
We do not host, receive, store, or have access to your database contents, queries, or connection details as part of normal operation. All interactions with your Elasticsearch or OpenSearch environments occur directly between your device and the target cluster. The App may use or integrate with third-party services and open-source components. Your use of those services may be subject to additional terms and privacy policies. We are not responsible for third-party services and have no control over their content or practices.
We may provide updates, upgrades, or patches to the App. You agree that we may automatically update the App as necessary to provide bug fixes or new features. Updates may be subject to additional terms which will be provided when applicable.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. BINARY WORK, LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BINARY WORK, LLC, ITS AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU FOR THE APP IN THE SIX (6) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED U.S. DOLLARS (US$100) IF NO AMOUNTS WERE PAID).
You agree to indemnify, defend and hold harmless Binary Work, LLC and its officers, directors, employees, agents, affiliates and partners from and against any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees and costs) arising out of or in any way connected with: (a) your misuse of the App; (b) your violation of these Terms; (c) your violation of applicable laws; or (d) any activity conducted through your account.
We may suspend or terminate your access to the App or Services, with or without notice, if you breach these Terms. Upon termination, your license to use the App will terminate and you must stop all use of the App. Provisions which by their nature are intended to survive termination (including sections on Restrictions, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law) will survive.
You agree to comply with all export and import laws and regulations that apply to the App. You shall not directly or indirectly export, re-export, transfer or otherwise dispose of the App to any country, entity or person prohibited by applicable law.
These Terms will be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute, claim or controversy arising out of or relating in any way to these Terms shall be resolved exclusively in the state or federal courts located in San Luis Obispo County, California, and you submit to the personal jurisdiction of those courts.
We may modify these Terms from time to time. If we make material changes, we will provide notice via the App, our website, or email to the address you provide. Your continued use of the App after the effective date of changes constitutes your acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be struck and the remaining provisions will remain in full force and effect.
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.
These Terms, together with any documents they expressly incorporate (including the Privacy Policy), constitute the entire agreement between you and Binary Work, LLC regarding the App and supersede any prior agreements between you and Binary Work, LLC relating to the App.
